Be Local is a digital platform that:
- Provides information about Barcelona shops to tourists.
- Offers thematic and local routes that include these shops.
- Allows shops to offer promotions redeemable via QR code validation.
- Facilitates the purchase of TMB transport tickets and museum entries, acting as an intermediary or authorized reseller, as applicable.
2. Acceptance of Terms
Access, registration, or use of Be Local implies full acceptance of these Terms and Conditions, as well as the Privacy Policy and Cookie Policy. If you do not agree, you must refrain from using the platform.
3. Parties and Definitions
- Tourist User: an individual who creates an account to access information, routes, promotions, and purchase tickets/entries.
- Shop: an individual with economic activity or a legal entity that registers to publish information and offer promotions/routes.
- Promotion: a commercial offer from the Shop, redeemable via QR code validation at the establishment or indicated channel.
- Routes: itineraries created by Be Local or by Shops/associations, which may include stops, promotions, and geolocated content.
- Tickets and Entries: transport products (e.g., TMB) and cultural products (e.g., museums) purchased through the platform, subject to the provider's terms.
4. Capacity and Minimum Age
- Tourist Users must be 18 years or older and have legal capacity to contract.
- Shops must be legitimate owners of the activity, with correct Tax ID and fiscal data.
- Be Local reserves the right to suspend or cancel accounts in case of fraudulent or unlawful use.
5. Registration and Accounts
5.1. Tourist User
To access promotions, routes, and ticket purchases:
- Must register and create a profile with minimum data (e.g., name, email, password, country of origin).
- May require email verification and specific consents (e.g., geolocation for route optimization).
- The User is responsible for maintaining credential confidentiality and reporting unauthorized access.
5.2. Shop
To publish information/promotions/routes:
- Must register with business data (trade name, Tax ID, address, contact person, email).
- May require supporting documentation (license, tax registration) and basic KYC/anti-fraud validation.
- Fees: Shops not affiliated with Barcelona Comerç or Comertia will pay fees according to the current tariff published in the Shop panel or specific contract.
6. QR Promotions
- Promotions are redeemed via QR code validation at the establishment or authorized channel.
- Each QR validates one redemption per promotion unless otherwise stated.
- Promotions have specific conditions (validity, exclusions, schedules, limited units). Shops must publish and comply with them.
- Be Local may audit validation logs for fraud prevention.
- Promotions are non-cumulative unless expressly indicated.
7. Routes
- Routes may require geolocation; Users can enable it for recommendations.
- Be Local may personalize routes based on preferences and location (if authorized).
- Routes are indicative; Be Local does not guarantee availability, schedules, or quality of Shops included.
8. Purchase of TMB Tickets and Museum Entries
- Be Local acts as an intermediary or reseller; provider terms prevail for use, validation, changes, refunds, and incidents.
- Before purchase, total price, taxes, fees (if any), and product conditions will be displayed.
- Refunds: subject to provider policy; digital products are generally non-refundable once issued/downloaded.
- Be Local may use third-party payment gateways; Users must accept their terms.
- In case of technical error, Be Local will liaise with the provider; Users must provide evidence (screenshots, emails, order references).
9. Prices, Billing, and Taxes
- Prices are shown in EUR and include taxes where applicable.
- Shops are responsible for tax compliance and price accuracy.
- Be Local may charge commissions or fees to Shops; details will appear in the Shop contract, admin panel, or annexes.
10. Content, Intellectual Property, and Licenses
- Platform content (texts, designs, routes, databases, trademarks) is owned by Fundació Privada Barcelona Comerç or licensed third parties.
- Shops grant Be Local a non-exclusive, worldwide, royalty-free license to display, reproduce, adapt, and distribute their content within the platform and related communications.
- Users grant similar rights for reviews and comments.
- Prohibited: mass copying, scraping, database reversal, unauthorized commercial use, and derivative works without consent.
11. Usage Rules and Moderation
Prohibited:
- Illegal, misleading, defamatory, violent, discriminatory content or rights infringement.
- Identity impersonation, duplicate accounts, use of fake QR codes, or validation manipulation.
- Sending SPAM, malware, or intrusion attempts.
Be Local may moderate, delete content, and suspend accounts for violations.
12. Liability and Warranties
- Be Local provides the service "as is" without guaranteeing uninterrupted availability or error-free operation.
- Be Local is not liable for quality, prices, compliance, or safety of Shop products/services or route experiences; Shops are solely responsible.
- For ticket purchases, liability lies with the provider.
- Be Local's liability for direct damages is limited to the amount paid by the User in the last 12 months; excludes indirect damages, lost profits, or data loss, except as required by law.
13. Data Protection and Privacy
Be Local processes data under GDPR and Spanish Data Protection Law. Key info:
- Controller: Fundació Privada Barcelona Comerç (Tax ID G63433650).
- Purposes: account management, routes/geolocation (if authorized), QR promotion redemption, fraud prevention, support, communications (with consent), purchase management, analytics.
- Legal Basis: contract execution, consent, legitimate interest (security/fraud prevention), legal obligations.
- Recipients: payment providers, TMB, museums, email/SMS services, analytics platforms, authorities when required.
- International Transfers: if any, secured by standard contractual clauses or equivalent safeguards.

- Be Local may implement basic KYC for Shops and fraud detection (e.g., misuse of QR codes).
- Suspicious operations may be blocked and additional checks requested.
16. Commercial Communications
- Be Local may send communications about routes, promotions, and news if the User consents.
- Consent can be revoked anytime.
17. Cancellation, Suspension, and Termination
- Users may close accounts anytime; no refunds for services already provided.
- Be Local may suspend or terminate accounts for violations, fraud, or legal requirements.
18. Third-Party Links and Services
The platform may include links and integrations from third parties (e.g., TMB, museums, payment gateways). Be Local is not responsible for their operation or policies.
19. Right of Withdrawal
- For digital services executed immediately (e.g., ticket issuance), withdrawal rights may not apply under consumer law; this will be stated before purchase.
- For other services, applicable consumer law will apply.
20. Advertising and Price Transparency (Shops)
- Shops must publish final prices and clear conditions.
- Misleading advertising is prohibited. Be Local may require corrections or remove content.
21. Governing Law and Jurisdiction
These terms are governed by Spanish law and, where applicable, Catalan regulations.
- Consumers (Tourist Users): disputes submitted to courts of the User's domicile.
- B2B (Shops): disputes submitted to courts of Barcelona.
22. Amendments
Be Local may modify these Terms; the current version will display the update date. Material changes may require renewed acceptance.

Annex A. Specific Conditions for Shops
- Registration and Verification: Shops provide accurate data and documentation; Be Local may request additional checks.
- Quality and Compliance: Shops guarantee truthful promotions and compliance with consumer and advertising laws.
- QR Validations: Shops use official validation methods and accept Be Local's logging for audits.
- Payments, Fees, and Commissions: Non-affiliated Shops pay applicable fees; Be Local may apply commissions for extra services.
- Settlements: Be Local provides reports and settlements; Shops must review and report discrepancies promptly.
- Promotion Removal: Shops may remove unredeemed promotions; committed ones must be honored.
- Liability: Shops indemnify Be Local against claims related to their products/services.
- IP and Branding: Shops authorize use of their brand and content for platform promotion.
- Sector Compliance: Shops offering regulated services must comply with applicable laws.
Annex B. Specific Conditions for TMB Tickets and Museums
- Provider Terms Prevail: use, validity, penalties, changes, and refunds follow provider policies.
- Access and Validation: Users must follow provider instructions (codes, QR, dates).
- Incidents: Be Local will liaise with providers; Users must provide purchase references.
- Non-Transferability: tickets may be personal or non-transferable per provider terms.
